郭立昌談習近平的反貪腐

821下午「富裕台灣計畫」悄悄地在民間重新起爐,主講人郭立昌是APEC領袖會議「反貪腐才能落實APEC最佳實例」之倡議者,會場爆滿,彰顯民心向背的景況;同時在台北,聯合國要求而召開的「反貪腐國際審查會議」由副總統陳建仁宣示:「承諾履行『聯合國反貪公約(UNCAC)的規定,積極檢討反貪腐的情形---」這是海島貪腐集團首腦在APEC 2006領袖會議向郭立昌嗆聲道:「啊,台灣『不是聯合國的會員』,管不著我們的啦----」經過12年,舉辦的正式會議;可惜,台灣已經錯失「APEC最佳實例」那10兆美元商機的最佳時機,惟若能把握今年11月的APEC領袖會議,復興台灣的經濟仍是有可行性。

欣見台灣的「反貪機制」終於啟動了,台灣加油!「富裕台灣計畫」落實最後一哩路的事工有譜脈了!


台灣和中國大陸都是APEC(亞太經合會)的會員事實上,APEC是台灣以「中華台北」名稱在國際重大會議唯一可以著力的平台。立昌受邀出席2006年越南河內APEC領袖會議,報告我們贏得的「APEC 2003最佳實例」之進度,被安排住進超高維安等級的講師和政經領袖住宿之「蘇菲特爾酒店(Hotel Sofitel),大家問:「Linda(指內人丁玲虹)怎麼沒有來?」聽聞我們在海島遭受公器加惡徒的肆虐經過之後,大家不約而同地說:You’re persecuted by your government!」大家定義迫害者為「the Entities of Corruption(貪腐集團),接著Anti-Corruption(反貪腐)之聲此起彼落,大家決議提交大會,將「反貪腐」列為長程議題,進而在2008年的APEC領袖會議發表「利馬反貪宣言(the Lima Anti-Corruption Declaration),確定「打擊區域經濟體的貪腐行徑領袖們認為:

1. 貪腐在公部門和私部門都是嚴重地威脅到本區域的社會和經濟發展(Corruption in both the public and private sectors is a serious threat to social and economic development in the region.)

2. 當犯罪實體勾結腐敗的公私部官員時,其行徑將導致逍遙法外(impunity)和合法的經濟遭剝削的文化(it results in a culture of impunity and financial exploitation of the legitimate economy.)

領袖們同意:

利用我們的集體意志打擊貪腐,以及促進廉潔的政府,建立打擊相關跨國非法網絡(We agreed to leverage our collective will to combat corruption and related transnational illicit networks by promoting clean government,)

領袖們支持:

1. 公私合作夥伴關係,促進商場誠信,以及透明的金融體系(transparent financial systems),因為貪腐的定罪可促進更大的區域合作(the criminalization of corruption can facilitate greater regional cooperation)而且支持我們APEC先前的反貪腐承諾(In support of our earlier APEC anti-corruption commitments)

2. 督促各經濟體承諾制定全面的反貪腐策略(to develop comprehensive anti-corruption strategies)—這些措施包括:努力恢復公眾的信任和防範金融體系的濫用,經由金融情報和執法合作,遏止行賄和非法資金流動(corrupt payments and illicit financial flows),這些反貪腐活動經由APEC,都與「聯合國反貪腐公約(the UN Convention Against Corruption, UNCAC)一致。

領袖們鼓勵:

經濟體批准和執行修改後的金融行動特別工作組(Financial Action Task Force, FATF)的建議;歡迎「利馬反貪腐宣言」針對金融市場誠信,經由有效的公私合作夥伴關係與APEC反貪腐公私行動準則(through Effective Public-Private Partnerships and the APEC Guidelines for Public-Private Action against Corruption)來落實「反貪腐」的決議。

各經濟體恪遵大會決議,推動「反貪腐」的事工;惟海島的貪腐集團變本加厲地,使出渾身解數,進行「搗巢行動」。立昌不得不放棄在美國辛苦建立起來的基礎,趕回來幫那個一心只想「富裕台灣」、「為下一代開出路」的「國防雇員的女兒丁玲虹」,處理被蝗蟲螞蚱肆虐過後的殘餘真的是滿目瘡痍,不忍卒睹。差一點在2009年八八風災颶風暴雨當天,落難街頭,問天,只見大雨直直落!幸好,堅定的「信仰」,使我們度過驚濤駭浪,相信終有一天,義人的路會如同黎明的光,越照越明。

反觀大陸,習近平先生自2012年執政之後,即強力執行「反貪腐」的工作;轉眼2014年,大陸在北京主辦APEC時,提出了「北京打貪宣言(the Beijing Declaration on Fighting Corruption)領袖們一致地表現出打擊貪腐方面的堅定決心,包括經由有效的反貪腐措施,並歡迎《亞太經合會關於防止賄賂和執行反賄賂法律的原則(the APEC Principles on the Prevention of Bribery and Enforcement of Anti-Bribery Laws)以及《亞太經合會有效的自願性企業合規計劃的通用要素(APEC General Elements of Effective Voluntary Corporate Compliance Programs)領袖們承諾共同打擊貪腐,並拒絕替貪腐官員及其非法獲取的資產提供庇護,並且致力於經由使用反貪腐機制和平台例如「亞太經合會反貪腐和執法網絡(the APEC Network of Anti-Corruption and Law Enforcement Agencies, ACT-NET)加強在貪腐官員的遣返或引渡的合作與協調(to strengthening cooperation and coordination on repatriation or extradition of corrupt officials),以及沒收和追回貪腐收益方面的工作(confiscation and recovery of corruption proceeds)

2016APEC領袖宣言,則回應道:「領袖們歡迎《利馬法(Lima ACT Statement)關於打貪的聲明,並鼓勵所有經濟體採取關鍵的反貪腐行動(to implement critical anti-corruption actions),特別著重於賄賂國內外公職人員(public officials),並確保所有相關的利害關係人(relevant stakeholders)之有效參與,包括通過APEC反貪腐機構和執法機構 (the APEC Anti-Corruption Authorities and Law Enforcement Agencies, ACT-NET)」確認執行北京打貪宣言的「反貪腐和執法網絡(ACT-NET)

我們先把意識型態放一旁,審視大陸在習近平先生主政這六年的變化,可以看出其國家基礎建設每年都有長足的進步例如高速鐵路的公里數將多達三萬公里,一般的高速公路則四通八達,每個都市的市容皆相當地現代化;而立昌帶至2001年上海APEC的「非現金交易制度」、「非接觸式感應科技」、「射頻科技」、「傳訊科技」等等,皆已經被廣用於民間;原本我們200286到北京簽約的「電子商店系統六億美元」的示範應用,其「虛擬通路」部份已經在大陸成為人民日常生活所需。

然而,我們為富裕台灣而發明的APEC最佳實例,居然在海島被監察院王某列為「密件」至2017816而且恐嚇你:「不要再提起你們的發明了,否則----日前,APEC主辦單位問:「請問您認為促進區域經濟發展的『關鍵要素』是什麼?」我的答案仍一如往昔地答道:「反貪腐(Anti-Corruption)」因為貪腐若不從這地被翦除的話,優質意識難以提升,有再好的創新產業和科技皆無法利益普羅大眾,當然會阻礙到「普遍性的繁榮」,所以反貪腐乃是第一要務。如今,海島當局竟然是聯合國要求而召開的「反貪腐國際審查會議」,才由副總統陳建仁出來宣示:「承諾履行『聯合國反貪公約(UNCAC)的規定----」的確是:「道途雖遙,勤行必至。」

立昌自1989年放棄名利,投入無限的心血和資源,協助玲虹完成「富裕台灣的發明」,爭取國際法案和政策,主要的目的在於維持台灣的「產業優勢」;可惜,卻在貪腐橫行之下,唯見劣質意識的洪流淹沒了起初的愛。今天,在「富裕台灣計畫」講座的末了,立昌帶著大家祈禱:「願大家為富裕台灣禱告,願天上的神垂憐台灣,願天佑台灣!」

 

作者郭立昌早年創造台灣的精密工業,在APEC領袖和部長會議促成「反貪腐、最佳實例、防止電磁干擾、電子商務、全球通路、孵蛋器、智慧財產權、微型企業、人工智慧」等議題和法案;著有「為下一代開出路、公義的經濟社會、社會責任、W型社會、為台灣開出路」等書。

UNCAC & A Megatrend of Anti-Corruption

UNCAC is targeting ‘Anti-Corruption’; nowadays, it has become a spindle of the Debate of Taiwan’s Presidential Election. How to open the way for next generation? The answer is ‘Eliminate Taiwan’s Corruption’ and renewal Taiwan to increase the strength for new era, and thereafter, peace and prosperity will come again.

UNCAC, the UN Convention Against Corruption is the most comprehensive anti-corruption convention, entry into force on 14 December 2005; UN’s Global Compact determined to eliminate corruption for the purpose in order to build sustainable, inclusive and transparent societies. In October 2015, TPP has set the rule and in Chapter 26 as a special chapter for Anti-Corruption, expecting to implement the government's transparency and good governance. The APEC 2015 CEO Summit of November held in Manila, Philippines, the Leaders recognized that corruption impedes economic sustainability and development, in order to building inclusive Economies, they agreed to combat the harmful effects of the illegal economy and to promote cultures of integrity across borders, markets, and supply chains, and reaffirmed their commitment to open and accountable governance and to promoting international cooperation in the areas of repatriation or extradition of corrupt officials, asset recovery, criminalization, and prevention of corruption among APEC member-economies, this is in line with the provisions of UNCAC from ‘Prevention, Criminalization, International Cooperation’ to ‘Asset Recovery’. APEC Leaders declared supporting the APEC Network of Anti-Corruption Authorities and Law Enforcement Agencies in advancing pragmatic anti-corruption cooperation and welcome the Cebu Manifesto for the Protection of Anti-Corruption Officials. From UN to the regional agreement and declaration, we’re told that ‘Anti-Corruption’ has become a megatrend in the world.
In accordance with article 68 (1) of resolution 58/4, the UNCAC entered into force in December 2005, a Conference of the States Parties is established to review implementation and facilitate activities required by the Convention. UNCAC covers a wide-range of corruption offences, including domestic and foreign bribery, embezzlement, trading in influence and money laundering. The UNCAC provisions obligate State Parties to take a number of public and private anti-corruption measures of ‘‘Prevention, Criminalization, International Cooperation and Asset Recovery’. The UNCAC constantly updated and reinforcement and established the ‘Review Mechanism’ since the signing of it for implementation of its purposes.
Viewing the APEC 2015 for building sustainable and resilient communities and disaster-resilient economies, and building on Leaders’ commitments in previous years, they will take actions to combat wildlife trafficking and related corruption through further reducing illegal supply, transit, and demand; strengthening domestic and global enforcement, enhancing legislative frameworks, and other criminal justice tools, enhancing efforts in each of our economies to treat wildlife trafficking crime seriously; and increasing cross-border law enforcement cooperation, and other interaction among wildlife enforcement networks as appropriate. These APEC’s objectives are same as the affairs of the UNCAC.
In regarding to the Chapter 26 of TPP Agreement to Anti-Corruption, 12 Parties agreed to ensure certain due process rights for TPP stakeholders in connection with administrative proceedings, including prompt review through impartial judicial or administrative tribunals or procedures. They also agreed to adopt or maintain laws criminalising offering to, or solicitation of, undue advantages by a public official, as well as other acts of corruption affecting international trade or investment. And Parties also committed to effectively enforce their anticorruption laws and regulations. As to the public officials, they agreed to endeavor to adopt or maintain codes or standards of conduct for their public officials, as well as measures to identify and manage conflicts of interest, to increase training of public officials, to take steps to discourage gifts, to facilitate reporting of acts of corruption, and to provide for disciplinary or other measures for public officials engaging in acts of corruption. Look back to APEC 1997, we proposed that ‘Code of Ethic’ as one of Teaching Materials to the ‘APEC Sub-Institute of SME Consellors Training & Certification’, it’s in line with the recent TPP’s rule to the public officials, because the collusion between public sector and private sector is the most serious acts of corruption which must be thoroughly eliminated from the information society of 21st century.
In fact, we had submitted at APEC 2003 about a view to the ‘corruption’ that “Corruption is a major obstacle to social and economic development.” And the response was “By working in 2004 at APEC of Chile to develop specific domestic actions to combat corruption and promote transparency by implementing our general and area-specific transparency standards through our Transparency by 2005 Strategy.” In spite of emphasizing by the Leaders’ Declaration; unfortunately, no legal constraint in APEC, the best practice ‘Global Channel-TES’ we proposed at APEC 2003 that suffered a serious non-economic factors interfere in Taiwan, and could not attain the mission goal. When the leaders who concerned the said best practice at APEC 2006 CEO Summit, they heard that inventor and speaker Linda Din was attacked to dementia, aphasia and amnesia by the public-private evildoers of Taiwan, they decided to enhance the theme of ‘Anti-Corruption’, and they identified corruption as one of the greatest obstacles to economic and social development, and agreed to fight corruption and usher in a community of integrity by effectively implementing APEC Anti-corruption and Transparency (ACT) Task Force's initiatives through enforcement of anti-bribery law, prosecution, law enforcement, and denial of safe haven. Moreover, they endorsed the APEC 2006 Key Deliverables on Prosecuting Corruption, Strengthening Governance and Promoting Market Integrity, and encouraged APEC economies to strengthen APEC's work and to complete a progress report on the implementation of ACT commitments by 2007. In addition, they instructed Senior Officials to work with ABAC and other business leaders to strengthen corporate governance to assure greater economic opportunities and prosperity.
Even so, the evil Moab-king who came to ask me for his strong cooperation willingness since 2000, he invited me at Hotel Melia of APEC 2006 in Hanoi, Vietnam to talk about continuing the previous matter of cooperation, I answered: “Just follow that year we’re talking about paying the Licensing fees of Patent TW#212870 for the TRD (Contactless Transaction Reading Device)…” However, those evildoers were not only paying any penny, but also laying the snares to unfold the ‘Action of Destroying the Nest’; they also mounted the TRD everywhere in Taiwan in April 2007 and neglected the Anti-Corruption Declaration of APEC.
The next year, ‘Lima Anti-Corruption Declaration’ of APEC in Peru clearly pointed out that “Combating Corruption in the Region, because corruption in both the public and private sectors is a serious threat to social and economic development in the region. Leaders recognized that when criminal entities collude with corrupt public and private sector officials, it results in a culture of impunity and financial exploitation of the legitimate economy. Consequently, they agreed to leverage their collective will to combat corruption and related transnational illicit networks by promoting clean government, supporting public-private partnerships, fostering market integrity and transparent financial systems. And they recognized that the criminalization of corruption can facilitate greater regional cooperation. In support of our earlier APEC anti-corruption commitments, they commended efforts undertaken by member economies to develop comprehensive anti-corruption strategies. These include efforts to restore the public trust and protect against the abuse of our financial system through financial intelligence and law enforcement cooperation related to corrupt payments and illicit financial flows. These anti-corruption activities through APEC are consistent with the UN Convention Against Corruption (UNCAC), which they encouraged economies to ratify and implement, where applicable. And also supported the revised Financial Action Task Force (FATF) recommendations, where appropriate. They welcomed the Lima Anti-Corruption Declaration on Financial Market Integrity through Effective Public-Private Partnerships and the APEC Guidelines for Public-Private Action against Corruption.
We’re grounded in a mission goal of ‘Open the Way for Next Generation’ to invent ‘The Electronic-store System’ (TES) which was a new-tech trade and economic system able to form a global channel for the nascent entrepreneurs gain better market access, and also as tool of a multilateral trading system to meet the Bogor Goal which announced at APEC 1994. The ‘E-Commerce’ proposed at APEC 1998 was in the ‘TES’ and the ‘ICT’ at APEC 2000 as well. But Taiwan’s corrupt group totally ignored the international conventions to attack the inventor to lose her three rights—‘Work, Property and Life’ securing by the Article 15 of Constitution. The Lima Anti-Corruption Declaration emphasized on that plague of corruption, but the furious attack of Taiwan’s corrupt group more stronger since 2008, and reached their plot of ‘Destroy the Nest’ in 2013. Meanwhile, we’ve been seeing the decline of Taiwan society, but the entities of corruption are still impunity.
APEC Anti-Corruption Declaration is in line with the UNCAC, the world is in this megatrend of Anti-Corruption, towards risk reduction, lower obstacles and fewer barriers. During the APEC 2015 in Manila, under the topic of ‘Creating the Future: Better, Stronger, Together’, the global famous firm—PwC did a ‘2015 APEC CEO Survey’, the result shown that 21 APEC Economies, about doing business in APEC, Taiwan ranked just in the front of Papua New Guinea, Brunei Darussalam, New Zealand, Russia, Peru and Chile, and far behind in the Philippines, Vietnam and Indonesia. Today, Taiwan is still hiring many foreign workers from Philippines, Vietnam and Indonesia. In case of continuing with impunity concerning the corrupt events such as food security, collusion between public and private, and those theft and infringement on IP; if it could not be ceased, serious tendency of decline might cause a certain day young Taiwanese to be Tai-labor of South-Asia countries..

TranSmart Card and Human Right

The invention of TranSmart Card was to deliver wisdom, spread kindness for actuating the business opportunities of trillion dollars to create many new jobs, and approaching the mission goal of Rich Taiwan; so that ‘TranSmart Card’ is a very important public goods in line with Article 15 of the Constitution said : “The Rights to Work, to Property and to Life of the people shall be guaranteed." When a person loses the right to work, the other two rights also at stake or precarious. Therefore, talking about ‘TranSmart Card’ is likely talking about the level of Human Right.


Back to the background of inventing the ‘TranSmart Card’, I must mention that Taiwan experienced the recession in the period of 1982-1985, every sectors were pondering the way of upgrading the industries. It’s very difficult to endure until receiving the orders of Consumer Electronics in 1986, NT dollar was required to appreciated rapidly by the mighty power from US$1:NT$40 to US$1:25Taiwan's national income was exploded on the surface, the manufacturing cost increased substantially, many foreign companies pulled out of Taiwan, they said: “Taiwan’s national income has exceeded US$ 3,000, there is no niche to invest here!” The most realistic consequence was left unemployed population to affect the social atmosphere; especially, the politics was uproar as President Chiang Ching-Kuo died on January 13, 1988. Under this background, ‘Way Back Into Love’ became the first priority. Consequently, I accelerated the research and development of ‘TranSmart Card’ and its transaction reading device (TRD/Toller) by means of the contactless-tech, expecting to form a new-tech trade and economic system (TES) as an instrumental solution to be a tool of salvation.
‘TES’ has two purposes: one is ‘Technologicalization of Traditional Industries’, another is ‘Intellectualization of Technological Industries’; the former can be attained through updating the existed stores or shops to the electronic-stores (eStores)—this has gained the bill of ‘E-Commerce’ at APEC 1998, the later can be through application of the ‘TranSmart Card’ as a key to open the door of entire commercial mechanism to penetrate the global markets, and to implement the mission goal of ‘Rich Taiwan’.
Recently, Taipei City Mayor Ko Wen-Je reviewed nearly a year about his administrative errors and said that “I’m harmed by a woman-- Yui Hatano!” The reason is that TaipeiEasyCard’ became ‘Yui Hatano card’-- in Taiwanese as ‘Boca’. The tide of Boca revealed the structural problems and mislead people. Actually, Yui Hatano is a dedicated porn star, she has an expertise place in the RX-rated films, those who were lack of knowledge unexpectedly put her image on the EasyCard—a common usage level. In my view, Yui Hatano is innocent in the event of Boca. In fact, Taipei EasyCard issued since 2002, it often came out the negative news, this is contrary with the original intention of inventing the ‘TranSmart Card’.

When we won the APEC Blueprint for Action on Electronic Commerce at APEC 1998, thereafter, we prepared the TranSmart Card & TRD to propose at Taipei City Hall on the 24th day of May in 1999, those officials led by the Deputy Mayor Pai Hsiu-Hsiung looked at the demo in kind curiously, they saw the Lanyu Canoe printed on the card, questioned that “How to issue this TranSmart Card?” I answered: “To assemble the existed manpower to be a group for operation, no need to add any extra-expenses…”  TranSmart Card can be used for Taipei MRT because it already completed, and then expanding to the fields of transaction and identification, the job creation will be occurred naturally.


As to the issuance that can combine with those existing post offices, gas stations and Chain Stores, the TranSmart Card can be processed by the Central Bank and deemed as ‘National Currency’ to fill the treasury and to facilitate the implementation of government affairs. The most importance is upgrading the economy of Taiwan from ‘Island-based’ to ‘Ocean-based’ in order to meet the requirement of ‘Information Society’ in the 21st century. In conclusion, ‘TranSmart Card’ is invented for securing the human rights – like job creation, not for profiting the entities of corruption.
